Terms of use

Access to and use of this site (the Participate Schools Website) is provided by: the BBC, ScienceScope, and the University of Bath (the Participate Partners). By agreeing to the terms of use, set out below, on behalf of your school you should ensure that all users (including staff and students) are aware of their responsibilities and that they adhere to them.

1.    Use of the Participate Site

1.1.    By using the Participate Site you agree to be bound by these terms. If you do not agree to be bound by these terms please do not use the Participate Site.
1.2.    The Participate Partners may change these terms at any time by posting changes online. Please review these terms regularly to ensure you are aware of any changes made. Your continued use of the Participate Site after changes are posted means you agree to be bound by these terms as amended.
1.3.    You agree to use the Participate Site only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the Participate Site. Prohibited behaviour includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within the Participate Site.

2.    Disclaimers and Limitation of Liability

2.1.    Any content appearing on the Participate Site, including any information, names, images, pictures, logos and icons is provided "AS IS" and on an "IS AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
2.2.    Under no circumstances will the Participate Partners be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the Participate Site regardless of the form of action.
2.3.    The Participate Partners do not warrant that functions contained in the Participate Site content will be uninterrupted or error free, that defects will be corrected, or that the Participate Site or the server that makes it available are free of viruses or bugs.

3.    Intellectual Property

The Participate Site content

3.1.    The names, images and logos identifying the Participate Partners or third parties and their products and services are subject to copyright, design rights and trade marks of the Participate Partners and/or third parties. Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any licence or right to use any trademark, patent, design right or copyright of the Participate Partners, or any other third party.
3.2.    The Participate Site contains content owned by the Participate Partners and by third parties including content submitted by members of the Participate schools project (Participate). Except for content posted by you, you may not copy, reproduce, republish, broadcast, transmit, distribute or otherwise use any content appearing on the Participate Site other than in accordance with the permissions granted in section 3.3. below. You are also not permitted under any circumstances to make such content available to the public, adapt, alter or create a derivative work from such content.

Your contributions to the Participate Site

3.3.    By submitting your contribution to the Participate Site (including any text, photographs, graphics, video or audio) you agree:

•    to grant to the Participate Partners, free of charge, permission to use your contribution (including modifying and adapting it for operational and editorial reasons) (i) for the Participate Site and any related Participate project websites; (ii) for research publications, conferences and presentations about Participate; and (ii) in relation to a study by the Participate Partner(s) into how technologies and services for learning activities could work in the future;
•    to grant to users of the Participate Site, free of charge, permission to reproduce and display your contribution solely for their personal non-commercial use ; and
•    to grant to educational bodies who are members of participate, free of charge, permission to reproduce, display and use your contribution for educational purposes within their educational establishment.

3.4.    Copyright in your contribution will remain with you and this permission is not exclusive, so you can continue to use the material in any way including allowing others to use it.
3.5.    In order that your contribution can be used in accordance with the permissions granted above, you confirm that your contribution is:

•    your own original work
•    is not defamatory
•    does not infringe any UK law; and
•    that you have the right to give the Participate Partners and other parties referred to above, permission to use it for the purposes specified above, and that you have the consent of anyone who is identifiable in your contribution. Any individual including yourself who is under the age of 16 and identifiable in your contribution must have completed and returned a signed parental consent form as distributed by your school.

3.6.    If the Participate Partners use your contribution for any of the permitted purposes listed above, the name of your school will be shown with your contribution as a credit.
3.7.    If you do not want to grant the Participate Partners the permissions set out above on these terms, please do not submit your contribution to the Participate Site.

4.    Indemnity

4.1.    By submitting your contribution to the Participate Site, you indemnify the Participate Partners against all legal fees, damages and other expenses that may be incurred by the Participate Partners as a result of your breach of section 3.5.

5.    Rules

5.1.    Ensure that any parental permissions that you believe are necessary are obtained by the school for your students to use the site.
5.2.    Please do not endanger yourself or others, take any unnecessary risks or break any laws when creating content you submit to the Participate Site.
5.3.    When making a contribution to the Participate Site (including posting any messages on the discussion forums), please be aware that users of all ages and abilities may be taking part. Please make sure that your contributions are:

•    civil and tasteful
•    constructive and polite
•    lawful

They must NOT be:

•    mean-spirited, disruptive, offensive or abusive
•    harassing, obscene, profane, sexually oriented or racially offensive
•    spam or off-topic

5.3.    PLEASE DO NOT reveal any personal information about yourself or anyone else (for example: full names, telephone number, home address or email address), and please do not include postal addresses of any kind. Please ensure that your students are aware of this requirement too.
5.4.    PLEASE DO NOT contribute anything that is defamatory or illegal or that violates, plagiarises or infringes the rights of third parties including copyright, trade mark, trade secrets, privacy, publicity, personal or proprietary rights.

6.    If you breach these Terms of Use:

6.1.    If you are a member of the Participate project and you fail to abide by these terms, the Participate Partners reserve the right to temporarily or permanently suspend your username and password.
6.2.    If you post or send offensive or inappropriate content anywhere on the Participate Site or otherwise engage in any disruptive behaviour on the Participate Site, and the Participate Partners consider such behaviour to be serious and/or repeated, the Participate Partners may use whatever information that is available to it about you to stop any further such infringements. This may include informing relevant third parties such as your employer, school or email provider about the infringement/s.
6.3.    The Participate Partners reserve the right to delete any contribution, or take action against any account, at any time, for any reason.

7.    General

7.1.    If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
7.2.    These terms shall be governed by and interpreted in accordance with the laws of England and Wales.

8.    Privacy

8.1.    The Participate Site is hosted by the Participate Partners hosting partner on behalf of all the Participate Partners. Any personal data provided in connection with Participate will be held by the Participate Partners for the purposes of administering the Participate project.
8.2.    The Participate Partners shall hold your personal data securely and will not share it with any third parties except (i) for the purposes of administering the Participate project; (ii) in accordance with the permissions you have granted at Section 3.3 above, (iii) with its technical hosting partner, Netsight Internet Solutions Ltd, as is strictly necessary for the technical operation of the Participate Site; and (iv) where the Participate Partners are permitted to or obliged to disclose such data by law.
